General Terms and Conditions (GTC)

Scope

These General Terms and Conditions (GTC) apply to all contracts between Tiertransport24 (hereinafter referred to as the "Provider") and the respective customer (hereinafter referred to as the "Customer") regarding the transportation of animals and comparable transport services.

Scope of Services

The subject of the contract is the transportation of live animals along an individually agreed route on a specified date.

The Provider undertakes to carry out the transport carefully and professionally in compliance with all applicable animal welfare regulations. Veterinary treatment or medical care is not part of the services offered.

Conclusion of Contract

A contract is concluded as soon as the Customer accepts an offer made by the Provider (e.g. by email, WhatsApp, or through brokerage platforms) and the Provider confirms the booking.

Once a transport date has been agreed upon and confirmed, the contract becomes legally binding.

Prices and Payment Terms

Unless expressly agreed otherwise, all prices are final prices.

Payment shall be made by bank transfer, cash upon handover, or by invoice, as agreed between the parties.

Customer Responsibilities

The Customer is required to provide all information necessary for the transport completely and accurately. This includes, in particular:

  • Information regarding the animal's health condition

  • Valid vaccination and travel documents

  • Correct collection and delivery addresses

  • A suitable transport crate, unless provided by the Provider

  • A contact person who can be reached at all times

The Customer confirms that the animal is fit for transport. Where necessary, the Provider may request a veterinary certificate confirming the animal's fitness for transport.

The Customer shall be liable for any damages or additional costs resulting from incorrect or incomplete information.

The Provider reserves the right to refuse transportation if there are reasonable concerns regarding the animal's fitness for transport or the safety of the transport.

Performance of Transport

Transport will be carried out with due regard for the welfare of the animal and with appropriate rest and care breaks.

Where possible, status updates or transport information may be provided during the journey. However, the Customer is not entitled to receive such updates.

Delays caused by traffic conditions, weather, official measures, or other unforeseen circumstances shall not entitle the Customer to withdraw from the contract, reduce the agreed price, or claim damages, unless such delays are caused intentionally or through gross negligence by the Provider.

Liability

The Provider shall only be liable for damages resulting from intentional misconduct or gross negligence.

The Provider accepts no liability for health issues, illnesses, or injuries occurring during transport that are not caused by negligent conduct on the part of the Provider.

The transportation of sick, injured, very young, or otherwise medically compromised animals is carried out entirely at the Customer's own risk.

In such cases, the Provider shall not be liable for any deterioration in the animal's condition or its death unless caused intentionally or through gross negligence.

Separate transport insurance shall only apply if expressly agreed in writing.

Cancellation and Withdrawal

Cancellations by the Customer must be made in writing.

  • Up to 72 hours before the agreed transport date: Free cancellation.

  • Between 48 and 72 hours before the transport begins: The Provider reserves the right to charge a cancellation fee of up to 50% of the agreed total price.

  • Between 24 and 48 hours before the transport begins: The Provider reserves the right to charge a cancellation fee of up to 80% of the agreed total price.

  • Less than 24 hours before the agreed transport date or in the event of a no-show: The Provider is entitled to charge cancellation compensation of up to 100% of the agreed total price.

The Customer expressly reserves the right to prove that no damage, or substantially less damage, has been incurred.

Right of Withdrawal

For services provided on a fixed agreed date, there is no statutory right of withdrawal pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB).

Data Protection

The Customer's personal data will be processed solely for the purpose of fulfilling the contract and will not be disclosed to third parties unless required by law.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed exclusively by the laws of the Federal Republic of Germany.

To the extent permitted by law, the Provider's registered office shall be the exclusive place of jurisdiction.
